Buyout Firm Hits Mayer Brown With $245 Million Refco Suit

The private equity firm that owned a controlling interest in failed commodities brokerage Refco Inc. has filed a $245 million lawsuit against Mayer, Brown, Rowe & Maw, accusing the law firm of helping to conceal the sham transactions that led to Refco’s collapse. Boston-based buyout firm Thomas H. Lee Partners filed a complaint against Mayer Brown on Thursday in federal court in Manhattan, alleging that Mayer Brown handled 17 fraudulent transactions at the behest of Refco’s executives between 2000 and 2005.

K&L Gates in Merger Talks With Dallas’ Hughes & Luce

Kirkpatrick & Lockhart Preston Gates Ellis is in merger negotiations with Dallas-based Hughes & Luce, with plans calling for a possible combination of the firms by the end of the year. Peter Kalis, chairman and managing partner of K&L Gates, says there is “enormous amount of enthusiasm” for the deal within his firm. The firms went public with the talks in order to stave off the rumor mill, says Edward Coultas, managing partner of Hughes & Luce: “Once you put anything out among two lawyers, it’s out.”

KLA Escapes Tough Backdating Penalty

Semiconductor equipment maker KLA-Tencor emerged Wednesday from an SEC backdating probe with barely a scratch, avoiding fraud charges and penalties entirely. This is probably the result, some in the defense bar say, of its extensive cooperation with the SEC — and an aggressive internal investigation carried out by Richard Marmaro, a partner with Skadden, Arps, Slate, Meagher & Flom. The SEC sang KLA’s praises and sent a message to other companies about the value of cooperation in its press release.

Edwards Campaign Leads the Pack in Contributions From Lawyers

Lawyers and law firms dropped another $13 million into the coffers of the 2008 presidential campaigns during the second quarter of the year, according to the Center for Responsive Politics. Since the start of the year, the legal industry has contributed $27.5 million to the campaigns, 66 percent of which has gone to three Democratic candidates: former Sen. John Edwards, Sen. Hillary Clinton and Sen. Barack Obama. Edwards, a trial lawyer, continues to lead in lawyer contributions.

N.Y. Federal Judge Strikes Down Many New Attorney Ad Rules

A federal judge has ruled unconstitutional most of the sweeping new restrictions on attorney advertising introduced this year by the New York courts. The restrictions had barred lawyers from such practices as using nicknames suggesting an ability to obtain results or touting “characteristics clearly unrelated to legal competence.” Prohibitions on active client testimonials, portrayals of judges and fictitious law firms and the use of Internet pop-up ads were also struck down as unconstitutional.
